Terms of Service

1. Agreement to Terms

By accessing or using My DJ Leads ("Service"), operated by Mark Chill Enterprises, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Be a resident of the United States or Canada
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws

3. Description of Service

My DJ Leads is an AI-powered lead generation platform that makes automated phone calls to venues on behalf of DJs to gather booking information. The Service includes:

• AI-powered voice calls to venues
• Call recordings and AI-generated summaries
• Lead management dashboard
• Venue contact information collection

4. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription Plans and Billing

Plans

We offer the following subscription tiers:

• Free (Bedroom DJ) – 3 AI calls per day
• Opener DJ ($9/month) – 3 AI calls per day with full features
• Resident DJ ($19/month) – 5 AI calls per day with premium features
• Headliner DJ ($29/month) – 7 AI calls per day with all features (coming soon)

Daily Call Limits

Daily call limits reset at midnight Pacific Time. Unused calls do not roll over to the next day.

Billing

Paid subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Refund Policy

All subscription payments are non-refundable. You may cancel your subscription at any time, and you will retain access to paid features until the end of your current billing period.

6. Acceptable Use

You agree NOT to use the Service to:

• Harass, spam, or make excessive calls to any venue
• Misrepresent yourself or your intentions to venues
• Collect information for illegal or unauthorized purposes
• Violate any applicable laws, including telemarketing regulations
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any purpose other than DJ booking inquiries

We reserve the right to suspend or terminate accounts that violate these terms.

7. Call Recordings

All calls made through the Service are recorded for quality assurance and to generate AI summaries. Call recordings are automatically deleted after 72 hours. By using the Service, you acknowledge and consent to this recording practice.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Mark Chill Enterprises and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT:

• The Service will be uninterrupted or error-free
• AI-generated information will be 100% accurate
• Calls will result in successful venue connections
• The Service will meet your specific requirements

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARK CHILL ENTERPRISES AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Mark Chill Enterprises, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
